Q: Why immigration lawyer would sign up for a case knowing case will fail, case would not work. Is it malpractice or scam?

Over year ago my attorney promised to get immigrant visa for my mom and my brother- her minor child. I read everywhere it was impossible because she is an immediate relative and cannot have any derevatives but he reassured me he could do it, took approximately 6k for work - signed the contract stating my mother and my brother. Now time has come for interview - only my mother, not my brother because immediate relative cannot bring anyone, just as I thought. Why my attorney did this to me, promised me it would work when it clearly wouldn’t? Was it malpractice or scam? What can I do? My family lives are ruined.

A: I am nor familiar with immigration law, so I cannot comment on whether the lawyer's reassurances were legitimate. However, I would suggest you get a second opinion from another attorney who does handle immigration matters. Also, you may want to consider filing a complaint with the Louisiana Office of Disciplinary Counsel should you feel that the lawyer charged you for services that he knew he couldn't deliver.
