Q: What rights do I have to a child I have been raising since infant if I am not related to him in any way?
My partner and I (both women) have raised him since 6 months & he is 8. Bio mom & older sibs live in another city in state. Mom has allowed my partner guardianship since 4 yrs-needed for school, doctors, etc. I have been mother figure- I take him to/from church, school, extra curricular activities, play dates, friends parties, Scout camping trips, etc. I pay for all extra curricular activities, after school school/summer camps, and at least half of clothing, school supplies, etc. He & I travel frequently together. I volunteer at least 3 days per week at his school, I am PTA President, and a Den Leader in his Cub Scout Pack, we were baptized into our church together and we are active members. Bio mom allowed my partner to begin adoption (she is uncomfortable w/me as I am mom figure to her son), but is beginning to waiver and the process is not complete. If things fall apart & mom changes her mind & wants her son back do I have grounds to fight for him?
A: You can file for custody, but the standard for custody actions for non-relatives is very high. You would have to prove both biological parents are unfit. You should consult with an attorney about your options.
