Q: Can an apartment complex do a remodel with you still being a tenant?
Hopefully you can help my roommate and I out. Our apartment complex has given us a weeks notice to remove all of our items in our foyer kitchen dining room closets and both bathrooms for them to do a complete remodel also not to mention we can’t have anything under our ceiling fan as they want to replace it (so where are we going to put our things?) are they allowed to do this? I haven’t been able to find anything in the state of indiana but other states say no. They are allowed to make minor repairs but I don’t see how they can remodel an apartment while we are living here. They claim it will only take day to do but it leaves us with multiple days of moving things. Kicker-if they are not in that area and there is a mess they said they would not clean it up and if we leave anything they will fine us $200..thoughts?

Tenants have the right to quiet enjoyment of the property. This can generally be thought of as a right to privacy, use of property above all others, free from disturbances, etc.. It most certainly applies in this case. If you are losing access to a large portion of your property and are being forced to relocate your belongings due to non-essential repairs, your landlord may be violating your lease agreement and your rights to the property.
