Q: Can I move from the Missouri State with my daughter without her fathers consent? We are not married, just live together.

My partner is in her birth certificate, I need to move because we are living together but he don't let me work, he controls everything including the money, intimidation, emotional abuse. He is using his male privilege so I can't take decisions. I am a Registered Nurse and I will not have problem to find job. He seems to be normal, but if we don't do what he wants he start to throw things, take our things and throw them to the garbage. I have a 13 year old son that is not his and his always criticizing him and he hides food because he don't want my son to take snacks. I call to a shelter and to a counselor, they told me that here in Missouri my partner can say that I kidnap our daughter if I escape from him. Can I just only escape without going to the police and accuse him of domestic violence? Because I want to get out of here with my two children and don't want to see him anymore, even in court. (On 2017 we had a case of domestic violence in Puerto Rico and he made me file the case).

A: If the two of you were never married, then he has no rights to the child and you may move as you wish. He does have the option of pursuing a custodial rights through a paternity action; but until that time, you are the only one with rights to your child.
