Q: I want to know if I can sue the company my husband works for.
He is having an affair with a lady he hired to work for him. Also, when he was hired on with the company we lived in Texas. The company is based out of Omaha Nebraska and has an office in Charlotte NC. He was told by the company that he could work from home. In 2015 we moved from Texas to TN. After we moved to TN his company made him start going to Charlotte every week to work. They wouldn't let him work from home any more. I believe this, in part, contributed to him having an affair since he was only home on the weekends. I make less than $25,000 a year. He makes approximately $120,000 a year.
A: Unfortunately, I do no think you have a case against the employer- your husband might have a case if he had a contract of employment ( most people do not have a written contract) which stated he could work from home. If so, the employer breached the contract by requiring the trips. As far as your case, Tennessee law abolished the tort of "alienation of affections" many years ago.
