A: Oregon courts consider the accrual of any equity or value in assets during the marriage a "marital asset." This is subject to some caselaw that considers how much "commingling" occurred with each asset. The seminal case regarding the issue of commingling is Kunze V. Kunze. In general, as long as the asset was not held separately (meaning it was premarital and any accrual in value was passive or initially intended for the other party, like inheritance) it will be a marital asset regardless of who holds the title. This is a complicated area of the law when the marriage is short and there are a lot of premarital assets.
