Q: Taking custody of my troubled niece with occasional drug use CYS case what are my rights? I am with her 24/7 no isse

Child’s Mother is a drug addict in jail. Father is my brother, niece has no respect for him or his wife. Child consistently told she was a mistake And just like her mother. Never been to counseling placed in foster care, ran away, had drug evaluation and no treatment was recomended. When she ran away for over a month and couldn’t be found she reached out to me she was here 2 weeks no issues, only out of my sight for a few hours on Friday I was told she was using heroin and she had shown no signs of use. CYS came to the house before we got back home on Monday, they drug tested her and found methamphetamines in her urine and made her go back to her father whom she hates they made him forceable put her In the car kicking and screaming Aunt Becky you promised if I did it the right way I could stay with you! While the caseworker threated to commit her 2 days later my brother called and told me to come get her he was done (again) I filed for custody in NY he agreed. Child will be 18 in 5mth

A: I'm not sure how to answer your questions from a jurisdictional standpoint! I see you're asking your question from Maryland, and talking about filing for custody in New York. Presumably your brother lives in Pennsylvania, and that's why you're asking your questions in this Pennsylvania forum?
