A: IN general a violation of a restraining order could be a 4th degree crime which is equivalent to a felony in most states. It is punishable by up to 18 months in jail.

In New Jersey there are no “felonies” but rather “indictable” offenses and “misdemeanors” which are disorderly person and petty disorderly person offenses. Depending upon the particular violation of the restraining order, the violation could be “indictable”. A violation of a restraining order in New Jersey is taken very seriously and is handled by the Superior Court and not at the municipal court level. It is important to protect your interests because a conviction for a violation of a restraining order can have serious consequences on your future.
