Lincoln, NE asked in Child Custody for Nebraska

Q: Ex husband who currently has physical custody of our daughter is intentionally keeping my daughter from me. He manages

her work schedule and is scheduling her almost everyday and has most recently sent a text stating he couldn't give a <expletive> if I see her or not. I'm not sure what to do.

A: If the other parent is violating the court order, the most common remedy to enforce the court order is to file a contempt action to ask for the court's assistance in enforcing the parenting time granted in the court order.

A: Since you mention he has physical custody, it sounds as though there is a court order in effect. If you also have court-ordered parenting time, you may be able to file a contempt action against custodial father for interfering with your parenting time. If the interference is severe enough, you may also consider filing to modify the current court orders. Your best bet is to visit with a local family law attorney confidentially about the specific facts in your situation and your legal options. Best wishes!
