West New York, NJ asked in Criminal Law for New Jersey

Q: I have been charged with harassment and trespassing & want to know if the accuser would have to testify in court

I sent some messages to a girl that I was friends with growing up (we lived on the same street) but she said she didn't remember me & that I had the wrong person. I knew she was lying & didn't understand why. So I kept pressing her & she started messing with me. She asked me to explain things further, asked for my phone # etc even though she had no intention of talking to me. So, I got upset & sent her some nasty, insulting messages but never threatened her. I tried to reach out to her a couple more times over the last couple years and most recently last month. She didn't respond. So, I went to a house i thought she was staying (she no longer lives in the country but visits in the summer) and left her a note saying I wanted to talk to her. Now, they say they have me on camera snooping around the house, looking in a window and taking a picture. She won't be in the country when i go back to court but wouldn't she have to testify & my lawyer have the right to question her?

A: The property owner can testify about the trespassing but she would have to testify about the harassment. You should stop this behavior towards her immediately. Everything you said suggests that you are obsessed with her and you're lucky they didn't charge you with stalking which is a felony crime that carries serious prison time. If I were you I would forget this person and move on with your life because your only other course of action is to escalate this behavior which will land you in jail.
