Q: My Lienholder on my truck repoed my truck from the towing yard where it was being held. Pmt current ins. current
On July 19, 2018 I was involved in a highspeed head on collision in my truck that resulted in it being towed to a local wrecking yard. I received traumatic injury to my left leg that required 2 surgeries and 24 days in the hospital. Upon my release on Saturday August 11, 2018 I began looking for my truck along with my insurance adjustor. I was told by the wrecker company that the lienholder had claimed the truck and repossessed it. I had never been late on a payment. My full coverage insurance was on file with the lienholder. Neither I nor the insurer received so much as a phone call or email inquiring on the status of the vehicle. They have run me around for 2.5 hours on the phone telling me nothing and refusing to divulge the location of my truck. Finally I found out how much money they are trying to extort from me. Once that is paid they will reveal the location of the truck and allow my insurer to take possession of the truck and begin processing the claim.

If it wasn't your fault contact a member of the La. Trial Lawyers Assn--they give free consults. Given that the vehicle would likely be totaled it's a situation with a possible conversion or unfair debt collection practice but no harm no foul. But get a consult with an attorney. What you want to do is ask the company questions. 1)get their record of your payments 2) get your records together. By the way--anyone reading--cancelled checks are great. So 1890/s but they still work for that. Because you can write on them what it's for--not so with electrontic funds transfer etc. Do they agree your were current--that's a yes no. Do not agree to anything. Note dates, times who you talk to. If they refuse to give last name then note that.
Document, also by then sending confirming letters. HARD COPY. If you must send them an email of the HARD COPY but do HARD COPY, snail mail return receipt requested.
