Q: My husband was arrested on simple battery & criminal trespass. Can I contact the DA and have this dropped?

The charges were Simple Battery, Family Violence Act-domestic Violence Act Violation & Criminal Trespass. We have never had anything like this, we are both new here I was transferred here for work, and he moved here after me, and started a new job about 4 weeks ago. He is currently living separately from me, on advice from the court. We do not have children in the home, we are an older couple. I have no reason to fear him, he didn't hurt me it was an argument that wouldn't stop and it needed someone to interfer. I didn't know what else to do but call the Police. Of course the arrest and then all of the red tape that follows isn't helping us as a couple. I would like to know if there is anything I can do to stop the process?

A: You can contact the prosecutor and let him/her know of your wishes, but the prosecutor controls whether or not the charges go forward.

A: I would recommend hiring a lawyer to represent him. You need to get the bond conditions modified to be able to have contact with him. You will probably need some guidance on how to navigate the court system. You do not have the legal ability to "just drop the charges" it is more complicated than that.
