Chicago, IL asked in Family Law and Adoption for Georgia

Q: Do I have any rights in an Open adoption? I am the mother of child father's rights recently terminated.

I have agreed to the open adoption but wanted to know can I request certain things be put into adoption papers to insure I get to be apart of my daughter's life.

A: Unfortunately, that's not how this works. If you consent to an adoption, you are consenting to the complete and total termination of your parental rights. Once you've signed, and the statutory time frame to change your mind has expired, the Court will terminate your rights with respect to the child. At that point, legally, you are no more related to the child than I am.

A: I agree with my colleague. You are giving up any rights to the child. Whether or not you would be able to keep on knowing what the child is up to or seeing the child would be at the consent of the adoptive parents. If they didn't agree to it then it most likely won't happen. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
