Q: If a ticket is "pulled" am I responsible?

I went 71 in a 40. This was my very first offense on anything. A family friend knew the chief who said it was fine and that he took it to just a warning. Being nervous, i checked the BMV site on my record almost weekly...nothing. even checked last week..nothing. Got a notice today that my license was suspended because of failure to pay. The ticket happened in march, the ticket was due in June, it is now August. I would have paid had I not got a go ahead that I was fine. What can I do?

A: It sounds like the ticket was not pulled, but rather it was filed. The issue was you were looking at the BMV site which would not show anything until there was a judgment against you or Failure to Appear/Pay suspension ordered. You should have been looking at mycase.in.gov; this is the clerks system that would have shown the case was filed.

You have 2 options: 1) pay the ticket and the court will remove the suspension, NOT A GOOD IDEA, as it will put/keep 4-6 points on your record and likely raise your insurance rates. Option 2, contact an attorney, if its a FTA suspension only he/she should be able to negotiate a reduced charge that won't affect your insurance or BMV record as badly as paying the ticket. If its both and FTA/FTP suspension he/she should be able to file a TR 60 motion and negotiate a resolution as stated with the FTA suspension scenario.
