Q: Can you be charged with Sex Abuse 1 if all you did was lick a minors foot?

My son is in jail awaiting sentencing for Sex Abuse 1 in Oregon. All he did was lick her foot. Can that be considered Sex Abuse?

A: Under Oregon Revised Statute 163.427(1)(a), a person commits the crime of sexual abuse in the first degree when that person subjects another person to sexual contact and the victim is less than 14 years of age and the victim is subjected to forcible compulsion by the actor, or the victim is incapable of consent by reason of being mentally defective, mentally incapacitated, or physically helpless. If your son licked the foot of a minor under age 14, and it was done with sexual intent or in a sexual manner, yes, he can be charged with Sex Abuse in the First Degree.
