Q: Am I violating a court order if direct deposit of spousal support is stipulated but unavailable?

My dissolution decree says that I'm required to have alimony direct-deposited into her account. The company that does my employer's payroll does not offer that service, she's been getting a check every two weeks for years.

This has been explained to her directly by my HR representitive several times but she's still threatening to take me back to court.

Can the DD order be enforced even if it's not an option? I have not seen this question ever come up before.

A: I seriously doubt she wants to take you back to court on the issue of whether her check is directly deposited or sent to her. My guess is she is mad about something else. That said, I don't understand the direct deposit issue. If a check is sent to her with her name on it by your company, it can also be sent to her bank and made payable to a specific bank account. It isn't the same as an electronic transfer of funds but the end result is the same. So ask her what the name of her bank is and what the account number is and ask your payroll to simply send checks to the bank made paable to the bank account number.

A: If you are the one sending the checks, you can get deposit slips for her account and send the checks to her bank yourself. Just make the check payable to the bank and the correct bank account number.
