A: You need to file a legitimation case. You should consult with an experienced family law attorney, as you also want custody and that can be difficult.

A: You will need to file a petition for legitimation in order to establish your parental rights and seek custody. Until you receive an order of legitimation from a court, you do not have any legal rights to the child. Given your concerns regarding her drug use, I would suggest speaking to an experienced family law attorney as soon as possible to discuss your options.
