Q: Hi after being convicted of simple poss. of marijuana, can I get a CCW or do I have to file for a restoration of my rig

Hi there after being convicted of simple poss. of marijuana, can I get a CCW or do I have to file for a restoration of my firearms right first? It’s been 5 years and I’ve completed all restraints; probation, fines, etc. It’s a misdemeanor by the way!

A: A misdemeanor drug conviction disqualifies you from obtaining a Carrying Concealed Weapon license pursuant to OCGA 16-11-129, unless 5 years have elapsed and there are no other disqualifying offenses. It would appear you are eligible to obtain the permit.

If you utilized a conditional discharge plea or first offender treatment on the marijuana charge you would also be eligible immediately and not have to wait the 5 years.
