Q: Can my husband still get custody of his son even though The judge issued temp. Custody/Gaurdianship to DFACS?

My husband filed to legitimize his son & sole custody. Dfacs has an open case on mother and the judge awarded Dfacs temp. Custody on the 9th. Our hearing is not until 11/13. Dfacs has placed child with moms xboyfriend and new girlfriend. Mother has consented to legitimation and custody. Parenting plan was filed and agreed on by both parents. He has been paying CS for 10 years and child was visiting 3/5 times a week now Dfacs has told us no contact because we refused to send his stuff to boyfriends house. Boyfriend is not supposed to be in home overnight, he has a violent history and can not pass drug screens. My husband has contacted Dfacs to do safety plan until court hearing and they refuse. Was told he had no rights yet the people who have him are not even kin to this child. I have contacted county director and nothing is being done. Looks like we will not have any contact until our court hearing. Is it likely the judge will leave child in the home with them since Dfacs involved?
