Q: How long can a landlord hold a security deposit after I have moved out no money is owed for anything its been 48 days

We moved out of out place they held about 230 dollars from the 1200 in security deposit and its now been 48 days and I still have not received a dime. The landlord told me that when they sent the dispursment of security funds sheet showing they took 230 for cleaning and what not that it was sufficient and that kept them with in the 45 days even though they have not refunded one dime of the security deposit. This company has a lot of complaints and I'm on the verge of taking them to court

A: Under the Virginia laws, a Landlord is required to submit an itemized statement of deductions from the security deposit within 30 days after possession of the premises is returned by the tenant to the landlord. The landlord is then required to pay whatever the amount of the security deposit to the tenant within 45 days after possession of the premises is returned by the tenant to the landlord. If the landlord did neither, the landlord is in breach of the lease. The tenant can file suit in the general district court where the property rental premises is located and make a claim for the security deposit based on breach of the lease.
