Cumming, GA asked in Family Law and Child Support for Georgia

Q: May I file interrogatories on opposing counsel's employer for records of income and expenses in a CS mod case he filed?

He is also in contempt due to arrears balance in CS and has never paid alimony although court ordered and 4 years behind. Do I need to file anything letting opposing council know that I have sent the discovery request for production of documents to the employer ? I don’t have to file anything with the clerk? Lastly what address is appropriate to list for documents produced for inspection and copying at ? Opposing has listed attorneys address and I’m pro se.

A: Yes, you can file discovery. You can and should also file a counterclaim for contempt of child support and alimony. Depending on the amount owed, if you hire an attorney, your fees can be reimbursed if he is found in contempt.
