Q: Can I drop a case towards somebody for domestic without the state picking it up??? So they can be released

A: The best short answer is that individual citizens don't charge people, prosecutors do.

Similarly, the prosecutor gets to decide whether to proceed with the prosecution or drop it.

A: No, it is up to the prosecutor to proceed or drop a case. You can contact the prosecutor and tell them that you no longer wish to proceed with the case but it is up to them to decide one way or the other. The person that is being charged really should have an attorney. That is the best option for them at this point.
