Q: How do you decide who will leave the home when a couple decides to separate? We do not have children together.

Does it bear any on who wants the separation? I have been told that whoever leaves the home can be accused with abandonment?

A: That's a decision each couple needs to decide on their own. Usually it depends on each individual's financial resources and who has somewhere to stay.

A: We don't have abandonment in Louisiana. If the home was purchased during the marriage and there are no children, then ultimately, one of you would have to buy the other out, or the house would be sold. You have equal rights to the home until then and a judge can order one of you to leave, if you can't decide between yourselves.
