Smyrna, GA asked in Child Custody for Georgia

Q: Is it possible to get a document stating that unwed moms in GA are automatically granted sole custody?

My son was born out of wedlock in Georgia. I know that means his father has no legal right to custody, however when dealing with passports and international travel his signature is required as he's on the birth certificate. Is there some type of form proving sole custody when rights have not been established? I'd like to avoid the hassle of getting dad to show up when its time to renew our child's passport, if possible. Thank you!

A: There isn't a form. You can apply to Superior Court to get an Order of sole custody

A: No, there is no document. Unless dad has legitimized the child, or the child was administratively legitimized at birth before that was abolished, then you don't have a right of action to file for sole custody. It's kind of like the sun rising in the east ... it just is what it is, there is no document decreeing that it is going to happen.
