Rincon, GA asked in Civil Rights, Constitutional Law, Divorce and Family Law for Georgia

Q: Can a change of venue request be filed in my divorce case if there is a history of misconduct by court officials?

Documents (application for stay away order) were approved fraudulently by the Superior Court Clerk (whom is a close family friend of my husband and inlaws) after the Magistrate Judge denied the application. This later resulted in me having to go to court for a violation of that order. This same clerk is who will now be handling all of the documents/orders for my divorce. There has already been an issue with a date being altered by 1 day on an order. I do not feel I will receive a fair hearing in this county. Do I have grounds for a venue change?

A: You may have grounds, but it would depend on the facts of the case. You should consult with an attorney who can review the documents in detail and present you with your options. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
