Q: Wife was driving pulled over due to alleged insurance lapse. As a passenger husband was asked for ID...searched & arrest

Wife was driving pulled over due to alleged insurance lapse. As a passenger husband was asked for ID... then police 'told' him he had a 31 year old warrant from another town. Husband placed in handcuffs and searched and then arrested for drugs allegedly in his possession. Released ROR same night. No other drug convictions or anything relevant on his records. Need help was recently homeless due to fire & economic upset... Currently new job very poor he supports disabled wife & son's.

All passengers, driver & vehicle subsequently searched... Nothing found. Driver issued summons for insurance lapse & allowed to leave.

Will probably need either a public defender or pro bono someone who can work with the defendant because they are very low income at present and there are no resources to help cover any legal expenses...

A: Apply for public defender in court. If wife produces insurance even if after the fact the PD will help with no loss of license. If Hus has no record PD will help with keeping it that way.
