Q: I just received a ticket that said I was going 90 in a 65. I know I was going 75. I don't plan to dispute that I was
speeding because I was, just the speed at which I was travelling. Plus there were other factual discrepancies on the ticket, like the location that the cop said I was pulled over is over 15 miles away from where the stop actually occurred. Can I fight this?
A: You can fight it but you will need an attorney to assist you with this matter because you are going to have to go to trial if you wish to fight it. An attorney may be able to get the prosecutor to agree to reduce the speed. The sooner you hire an attorney the better.
A: You always have the right to a trial. Success depends on a large number of factors including the ability of the police officer to testify credibly at trial. It may also be possible to negotiate an amendment to a lesser speed with the prosecutor. You may be best served by consulting directly with an attorney that practices in the courthouse where your case is pending.
