Greensburg, PA asked in Family Law and Child Support for Pennsylvania

Q: In 2012 I opened a case for child support and the father wasn't ordered to pay anything until he obtained employment

They after never updated his income even though he obtained on the record employment making more than me. In 2014 I asked for a modification but was told they couldn't see income for him and they would set up a conference asking him for documentation. I never received information and found out recently they closed the case. Can they close a case without the plaintiffs permission? Again, I never received information that I needed to be present or give them any information. I assumed (stupidly) they were taking care of it. Also, they are saying I need to open a new case for him now. Can I ask for back support to 2014 when they closed the case?

A: You should open a new case immediately. No, you cannot now seek past support.

Moral of the story: stay on Domestic Relations like white on rice. No one is going to advocate for you more than YOU. Best of luck to you.

A: I suggest that you contact a local attorney experienced in family law cases. The case may have been closed due to the fact that the DRO records reflected chronic unemployment, which you may still be able to dispute. In the meantime, it likely wouldn't hurt to open a new case too
