Blairsville, PA asked in Child Custody for Pennsylvania

Q: I currently have an attorney but feel as though nothing is being done. I am in a custody battle and going to pre trial.

My daughter is 12 and I let her live with her dad for a year. After the year 8she wanted to return home with myself and her sisters. Things have got very bad and her dad is emotionally and verbally abusive. I held a 3 year PFA due to his violence. His attorney states that he has a horrible temper. My daughter breaks down and resorts to crying, screaming and even threatens too run away if she has to go back or take his calls. I continue to encourage both but cant much longer. What can I do to help her stay with me at home? She is starting to refuse to go and tells myself and her therapist we dont understand what it is like being there and she hates it. He has a past of alcohol and drugs. He has overdosed with her being there and I picked her up at the police station. Please help me help her. I do not no how much longer I can force her and I feel she is in danger.

A: If you have an attorney already, then you need to address these concerns with him/her. If you aren't satisfied with his/her actions and response, then you can certainly find another attorney who will be more pro-active.

Presumably you can address these most immediate concerns with whomever at your pretrial conference? I'm not familiar with the local procedures in your neck of Pennsylvania, but your attorney should be.

A: You have an attorney. You should follow that attorney's advice. Often the court system seems painfully slow when you're in a situation such as yours. It's hard to see your child hurting so much and not be able to do much about it. Hopefully you'll get a trial date quickly.
