Denver, CO asked in Car Accidents for Colorado

Q: Can I be cited for accident when parked, opening Dr along a street. after a visual both over shoulder and by mirror?

There appeared to be no vehicles coming from behind me in either of the two lanes.

The Pueblo City van immediately hit the driver's door AS I was opening it. It was like he came out of nowhere. No injuries, but I was cited for section 1207 of Colorado State law and fined. The driver of the moving vehicle was not charged. I'm not sure if he was crowding the shoulder behind me or he switched lanes in a way that didn't permit me to see him coming. He stopped and thought he was at fault for the accident.

Should I pursue this legally?

A: If there's an intersection or other video that shows it maybe. As things stand no--because the fact it happened almost instantaneously means that in all liklihood you didn't take that last look in the mirror--otherwise you would have seen the car. It's one of those "objects in the mirror are closer than they appear" moments.
