Q: I have been charged with Possession of Meth with Intent to Distribute 16--13-30(b). A warrant was served on mother's

property were I have a shop.One pipe (dirt and police say white residue found outside shop.) One pipe and one working and one non working scales found in shop. O was not there when warrant was served. Does the evidence even meet the guidelines for this charge?

A: Unfortunately it does.

"Probable cause" means facts and circumstances within an officer's knowledge that are sufficient to warrant a prudent person, or one of reasonable caution, in believing, in circumstances shown, that a suspect has committed, is committing, or is about to commit an offense. Probable Cause is needed to obtain a search warrant. The probable cause for an officer's evidence search is that there is a substantial chance of discovering evidence of a crime. So, given what you stated above, there is a fair probability that contraband or evidence of a crime will be found in the particular place listed on the search warrant.
