Asked in Real Estate Law and Landlord - Tenant for Tennessee

Q: What exactly are my rights as a tenant in Tennessee if my name isn't on the lease?

My girlfriend and I live with my mother, her boyfriend, and my brother. My brother and mother are the only ones who have been put on the lease. We are in the process of moving into our own place, but my mother wants us to leave immediately without reason. She states that she "just doesn't want us here." She has threatened my girlfriend, and myself. Along with her boyfriend threatening me if I don't leave immediately. Until all the factors are checked and cleared on our new place, we simply don't have anywhere else to go. What is my best bet moving forward without becoming homeless in the meantime?

A: Legally the owner must file a Detainer Warrant against you all, serve or post it, get a Judgment for Possession, and if you are not out after ten days, have a Writ of Possession executed by the Sheriff to remove you.
