Asked in Child Support and Family Law for Georgia

Q: My ex is not contacting me about child support

I used to pay child support through a local organization in a Canada (we used to lived there and after divorce she moved in with her parents in Atlanta, GA). A few years after divorce I moved to another province so the organization contacted the both of us saying since neither of us live in that province anymore we need to contact each other to pay child support. I have tried to contact her and even tried to serve papers on her to go to court in GA but the sheriff's office replied that after multiple attempts they couldn't serve her or even contact her. The organization sent her a letter as well that she has to contact me for child support. Its been 7 months now, she hasn't contacted me at all. I have the money saved in my account but is there a timeline after which she cant come after me?

The final support order was domesticated in Georgia so all changes must be in GA. There is no contact with her, no bank info - nothing - as I was paying that organization upon her request..

A: If your support order originates from Canada, you should consult with an attorney in that jurisdiction to determine any statutes of limitations on your obligation to pay. Generally, if you have a mailing address or deposit account information for her, you should attempt to send the payment via mail or bank deposit.

A: I agree with my colleague, if this order originated in Canada then you should consult with an attorney there. The laws vary, so it's important to get their advice so it will be pertinent to your situation. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
