Q: I want to file for support against my ex but his check is already being garnished for back support on his adult children

We both live in the state of Louisiana. The state of Oklahoma is garnishing his check $750 a month on back support for his now adult children and just recently they started a garnishment for a civil debt. I want to file for support but I also do not want to leave him in a situation where he cannot afford to live. If I file for support will Oklahoma have to take less? Or will they stop the garnishment for his civil suit because it exceeds a percentage?

A: If your child was born after his adult children, then your child stands in line behind the adult children, but ahead of other creditor garnishments.
