Q: I am looking for help on child custody law in Hartland, MI. It seems like I only have visitation rights only.

I currently only have visitation rights for my daughter. Our FOC was originally located in Detroit, but the mom wanted to transfer to Livingston County and I agreed. Livingston County FOC sent papers to an old mailing address and I never recieved the papers to show up in court to figure out custody situation for my daughter. The FOC in detroit told me I had to wait 2 years or until the mom was done breast feeding. Two years was up and they said they sent papers to an old address and I never received it? But I also signed papers from the MOM in the transfer with my current address at the time. I have a feeling she edited/removed the address. I'm tired of not having over nights and only have 1 day week to visit my daughter for 2 hours and she tells me I have to leave the house. Please help me! Everytime I called Livingston FOC they told me I had to file a motion but no idea how to do it. Thanks.

A: You will need to file a motion. You may do so either through a local attorney or some courthouses have a legal assistance center that can provide you with the appropriate forms to get you started. Until a motion is granted and a new custody or parenting time order is in place, things will stay the same.
