Decatur, GA asked in Child Custody and Child Support for Georgia

Q: My husband is worried that the judge will order him to be locked up after non child support payments, is that possible?

They have had a court order set in 2016 saying she is the custodial parent and he gets the kids half of the time and pay child support to her, in 2017 we moved in together and she asked if the kids could live with us full time so from July 2017 to current the kids been living with us completely full time , we recently had a fight baby mother so she is now saying she is going to get back on us by going to court saying he hasn’t paid child support and to ask for full custody j

A: If the court order wasn't changed, he owes her the full child support. He needs to start making payments and exhaust all efforts to pay the money he owes. He also needs to hire an attorney and file for the modification to stop the payments, have her pay him and to change custody.
