Carrollton, GA asked in Family Law for Georgia

Q: Will a judge require me to sign passports to allow my Ex to take our kids out of the US for extended Summer Visitation?

My EX does construction work and takes jobs overseas. This time it's in Aruba and says he has a 90 day work Visa. His wife goes with him and now he wants to take the kids and tells me that any judge will side with him and make me sign the passports. I want to know if I have a chance in fighting this. The kids are both 13 and one has a learning disability. While with them last Summer in Puerto Rico he worked and the Stepmom allowed them to go by themselves to the pool unsupervised and no lifeguard and left them in the condo by themselves.

A: Possibly. Judges are typically in favor of international travel for children except in cases where there is a real and present danger of them being kept out of the country by the other parent. Unless there is a fear that the other parent will abscond with the child out of the country, a judge will probably grant the request for the passports.

A: I agree with my colleague, it is possible that the judge will ask for you to sign passports for them to engage in international travel. Unless there are red flags of possible problems the judge would likely grant the request. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
