Q: I was charged 16-13-2(b) less than one ounce of marijuana they want to give 12months probation 500 fine plus class

How can I just paid a fine instead of probation

A: In Georgia any person who is charged with possession of marijuana, which possession is of one ounce or less, shall be guilty of a misdemeanor and punished by imprisonment for a period not to exceed 12 months or a fine not to exceed $1,000.00, or both, or public works not to exceed 12 months. Ga. Code Ann. § 16-13-2.

You can request no probation. However, if they entertain that request you may certainly have to pay a higher fine or do something else. In addition, if this is your first offense probation is necessary for the conditional discharge option. I hope this helps.
