If so, all he needs to do is contact a personal injury Attorney in your area. A personal injury Attorney might take the case on a contingency basis and can also tell you how the liability issue looks.
Is your son trying to avoid paying for the other party's damages? Since your insurance lapsed you won't have the benefit of your insurance company hiring an Attorney to defend you.
