Q: Louisiana. Ex remarried 2dys after child support court. Does this change his income/need to be reported to enforcement?
Went to court through child support enforcement for arrears and change in payment amount since he is back on SSDI. He remarried a few days later. Does this need to be reported to enforcement? Why or why not?
A: A person's spouse's income is not taken into consideration for calculating child support. It can sometimes be used for purposes of asking the court for a deviation to the extent that the spouse's income frees up the parent's income from paying household expenses. This, however, is the exception rather than the rule. Another way of looking at it is that it is the parent's responsibility to provide for their children, not the step-parents.
