A: It depends from jurisdiction to jurisdiction. It also depends on whether this is a first time offense for you. There is not enough information to tell you exactly what the District Attorney may offer and may be impossible for us to do anyway. You need to hire an attorney before you go to court.

A: You need to hire a competent attorney. He should be able to get you on

a Diversion Probation, which when completed successfully, the Charge is Dismissed. Then you can Expunge the record. This is important or it will ruin your life. If you do not qualify for Diversion (which your should), there still may be ways a good lawyer can get it Dismissed.
