There are two components to the prove of any aggravated assault under O.C.G.A. § 16-5-21.
First, the defendant must commit an assault. Assault can be committed either by attempting to inflict a violent injury upon another or by placing another in reasonable fear of immediately receiving a violent injury. O.C.G.A. § 16-5-20.
Second, the assault must be committed either (1) with an intent to murder, to rape, or to rob, (2) with a deadly weapon, (3) with an object that is likely to or actually does result in strangulation, OR (4) by discharging a firearm from within a motor vehicle toward another person without legal justification. O.C.G.A. § 16-5-21.
