Q: Hello, how does an individual residential parent petition for a GAL for his 2 minor children?

The bio mother refuses to declare her living residence to the bio father, she keeps a 1 bedroom apartment and uses her parents and grandparents home for mail, but stays in other places where she takes the children. She separates them during her parenting time leaving one with her mother and she keeps the other. She has 4 children total and does not have custody of the older ones and has joint custody with the 5 and 6 year old. She does not adhere nor respect the parenting plan, demands them at will. She is not employed nor does she assist with any of the costs or expenses for the children. She interrogates the children to tears when they are with her, and the children fear getting in trouble with her.

A: I am sorry to hear about your situation. It sounds like you can file a motion to enforce parenting time if there is a violation of a prior court order. You mention that she demands to see the children at will, however you are only required to follow the parenting plan. If she is ordered to pay support and she is not paying, that is also the basis for a motion to enforce.
