Channahon, IL asked in Traffic Tickets for Illinois

Q: If I got a speeding ticket and immediately came home and I paid it and realized I want court supervision, can I still?

I was in Illinois and I’m 19 and have no records of a speeding ticket before. I got one for going over 20 mph but not exceeding 25 mph. I was so nervous and didn’t want to forget paying my ticket so as soon as I got home I immediately paid it. But as I was reading I realized I didn’t click on the part about applying for court supervision and driving school. So now I am freaking out that now I won’t be able to get out of it and I will have this on my record and possibly have my licenses suspended.

A: Contact the Clerk’s Office at the courthouse where the ticket is assigned to see if a conviction was already entered. At this point, I would assume that a motion to vacate would need to be filed at the courthouse if you want to keep the offense off of your record. The case can be brought before the Judge and you can request court supervision. An attorney can assist you with this process.

A: You won’t lose your license but this conviction puts you half way there. You can undo what you did and request supervision requesting the conviction be vacated.

A: It is likely that a conviction was entered against you and the Secretary of State will not send you a notice informing you that if you receive another conviction within the next 24 months your license will be suspended. You or your attorney need to file a Motion to Vacate Judgment and give proper notice to the prosecutor. On the hearing date for the Motion, you and your attorney need to appear and deal with the judgment. The sooner you hire an attorney the better.
