Saint Petersburg, FL asked in Collections for Florida

Q: Can a judgment creditor garnish the rental income of a judgment debtor in Florida?

The defendant would be a landlord who collects rent in cash only, and the creditor's judgment would be $1000.

A: This is a very unusual situation. Unless some other law applies and says otherwise, the judgment creditor needs to garnish the individual tenants, who would then have a legal right (and obligation) to pay the cash rents to the landlord, until the judgment is satisfied. However, I am uncertain about what might happen if the landlord tries to evict his tenants for not paying rent. Sounds like an interesting case for some small claims court.
