Q: Vehicle on highway in front of me stopped for an illegal uturn in median and caused wreck.. they fled scene. Now what?

Them stopping illegally caused me to wreck into the car infront of me. They didn’t want to call police, only exchange information. Should I file police report? I have it all on video.

A: You should file a police report. Were you injured? As you know in Florida you will have PIP so depending up how long ago the accident was, you may still be treated for your injuries. If you have any more specific questions, please feel free to email me directly" david@tapinjury.com

A: Good afternoon. I'm always in favor of and recommend calling the police (911) immediately after an accident while you are still at the scene. However, since that was not done, you can elect to file one now. I would recommend that you preserve the video you have in its unedited format. If you haven't already, you may also want to report the accident to your insurance company. Please keep in mind that the other driver or their insurance company may try and suggest you were negligent in whole or in part for hitting the car in front of you. They may claim you were following too closely, not keeping a proper lookout, etc.

If you were injured or are having any pain and discomfort you may want to consider seeking medical treatment. Depending upon when the accident happened, will determine if you can preserve the maximum coverage under your PIP coverage.

A: Unfortunately, their stopping illegally doesn't mean that you have a right to run into anyone. So I would suggest for starters you get a free consult with a member of the Fla Justice Assn before giving any more statements about what happened. I'm sure you don't mean to say that a sudden stop caused you --who doubless left enough room to stop in the assured clear distance ahead--to strike anything. But file the police report because even if they don't find them, it's an uninsured motorist event but to collect on uninsured coverage you have to have made a police report.
