Q: If my spouse, in court, admits to a crime, possession of prescription meds that aren't hers, what would a judge do?

A: There is no way to answer that question. Each judge is different, each situation is different, and the type of drugs are relevant. It's possible that it won't make much difference.

A: There are a wide variety of circumstances that could determine a judge's response. The judge's response may be different depending on whether they are in civil or criminal court, whether it is a child custody action, and most importantly what type of prescription drugs.

A: The real issue is what is how is your spouse charged? Assuming charged under Violation of Georgia Controlled Substances Act AND your spouse does not type of negotiation with the court and enters a plea, jail time will definitely be on the table as the statute requires jail/Prison. The second part entails which type of prescription meds were found? Answering these questions AND attempting to negotiate with the state will have large impacts on how the case will move forward (some schedules and weights for drugs have different sentencing guidelines for mandatory minimums).
