Q: Uncontested Grandparents Custody Petition.

The filing is being made, can we ask for modification to the visitation of the non custodial parent on grounds of it being harmful and not in the best interest of this child due to abandonment by non custodial parent and it has been 2 years without communication, parental responsibilities even if child support was never asked and it will not be asked? We have a Psychological evaluation that states it would be harmful to child’s emotional and mental state as well as physical harm an d not in the best interest of the child due to other issues and they refuse to try the reentry therapy sessions that are needed but not recommended.
