Q: Would my daughters biological father be able to get much visitation if I filed for child support ?

My daughters biological father has never been involved. He has never supported her, seen her 4 times in her 2 1/2 years, did not sign the birth certificate, I have video & picture evidence of him being involved with drugs, threatening me and my fiancé, refusing to give me an address to file with, blocking me when I tried to get ahold of him, evidence of him being in the same town but not checking up, asking about, seeing if she’s needs anything, etc. he pops up every few months claiming he wants something to do with her but then nevertheless follows through when I try to offer visitation. He has multiple drug, battery, and theft charges. I’m worried about her safety & if he would be awarded much visitation, if any. She has no idea who he is & looks up to much fiancé as her father .

A: Child Support and Child Custody/Visitation are two separate issues. Just because a parent is ordered to pay child support does not necessarily mean that they will also be granted custody or visitation rights. All children are entitled to receive support from both of their parents. In regards to custody and visitation, a court will always look to the best interests of the child in determining whether or not a parent should have custody and or visitation rights. In determining whether or not custody or visitation is appropriate, the court looks at essentially all relevant factors, including elements like history of abuse/neglect, druge use, violence, etc..

You should consult with an attorney in your area experienced in obtaining child support or reach out to your local county child support division.
