Macon, GA asked in Divorce, Family Law, Child Custody and Child Support for Georgia

Q: I live in GA and my spouse lives in OK with his mistress and their child. The mistress claims they are married?

The mistress wears a wedding ring and so does my spouse. I can’t find anywhere where they were legally married. We do have two children 17 and 10. I am currently moving to Louisiana in two weeks. I allowed my 10 year old son to be with him for the summer and my son is scared they are going to try to keep him. What are my options?

A: You should file for divorce and get a court order on custody. Your husband doesn't have to return him as he has as much legal right to your son as his father does. That can only be modified with a court order.

A: I agree with my colleague, at this point he has equal rights to keep him, as you do. You should seek a divorce, and work with an attorney to ensure everything is properly handled. -Homer P. Jordan IV, Esq. 404-620-1558 HomerJordan.com
